Residential Leases Under Colombian Law 820 of 2003
Residential renting in Colombia is strictly governed by Law 820 of 2003. Many foreigners rent without realizing that standard lease templates downloaded online often contain legally unenforceable clauses.
1. Prohibition of Security Deposits for Residential Leases
Under Article 16 of Law 820, landlords are strictly prohibited from demanding cash security deposits (depósitos en efectivo) for residential contracts. Guarantees must be structured through insurance policies (pólizas de arrendamiento) or co-signers (codeudor).
2. Automatic Renewal Notice Rules
Leases renew automatically under the same terms unless either party gives written notice via certified post at least 3 months prior to expiration.
3. Clear Demarcation of Repairs
Locative repairs caused by everyday wear are tenant obligations, while structural and necessary repairs (water leaks, roofing, pipe failures) remain the exclusive duty of the owner.
4. Early Termination Penalties
Tenants can legally terminate early by giving 3 months' advance written notice and paying an indemnity equal to 3 months of rent.
