What Happens to Your Colombian Marriage Visa If You Get Divorced or Separated? (Resolution 5477 Article 109)

The Fundamental Rule: Early Termination (Article 109)

A frequent misconception among foreign residents is assuming that a visa remains valid until the expiration date stamped on the physical visa foil or e-visa PDF.

Under Article 109 of Resolution 5477 of 2022, when the core circumstances under which a visa was originally granted cease to exist, the visa undergoes early termination (terminación anticipada).

Article 109 (Resolution 5477 of 2022): "Early termination of a visa occurs when its validity ends prior to the originally granted expiration date [...] The termination of the bond or effective cohabitation as a spouse or permanent partner of a Colombian national due to divorce, judicial separation, or de facto separation entails the early termination of the corresponding M Visa."

Obligation to Notify the Ministry of Foreign Affairs (Cancillería)

Both the foreign spouse and the Colombian citizen are legally obligated to promptly report any change of circumstances via a formal written notice addressed to the Ministry of Foreign Affairs (Cancillería).

Why is this step non-negotiable?

Accurate Legal Timeline: Formally notifying the authorities establishes the exact date your visa ceased to be valid, protecting your official immigration record.

Contested Separations: If the separation or divorce is non-amicable, submitting an official notification prevents unexpected administrative liabilities or unilateral reports.

Future Visa Eligibility: Failing to report status changes can trigger penalties, overstay records, or outright rejections when applying for future visas in Colombia.

What Is Your Next Step? (The 30-Day Window)

Once Cancillería processes the notification of early termination, the foreign national is granted a 30-calendar-day window to:

Depart the country in an orderly and compliant manner, or

Apply for a different visa category (e.g., Investor, Independent Worker, Pensioner/Rentista, or Digital Nomad) to maintain uninterrupted legal residency in Colombia.

Need Guidance Navigating Your Status?

If you are currently undergoing a marital separation, need assistance submitting formal notices to Cancillería, or want to transition seamlessly into another visa category, Capital M Law is here to make the process effortless.
